Its simple,,fill in form 10c and and form 19 and send it to HR. They should even help you get it direct deposit in to your local account in India. I got mine....it was pain-less. This was not with tcs,,,another company...

My case is not simple but i did not quit in usa either..i resigned without doing the notice period in india sometime back.

So is it possible to file 10C and 19 directly with the PF office and get the money without involving TCS?

Your ideas are highly appreciated.

No.3 and 4 are my favorites.....but No. 4 is the one I wud choose as best. I like the touch of green and the sky is superb. Horizon Line is straight on. The pic is sharp all around, but what really catches me when I first viewed the picture is the "bolt" in the fence.
I agree, and also agree with FNM's comments about why #1 and #2 don't work for me.

You can begin working for company B on your H as soon as company B files an H petition for you, since the H1B is portable. You can also begin working on your EAD for company B, although that will result in you no longer being in H1B status.

Any employment with company B is a violation of your H1B with company A. If the petition from company B is denied, you will no longer be in H1B status.

You could then go back to work for company A on the EAD. If you wanted to work for company A on the H1B you would have to leave the US and reenter on an H1B visa.

I am assuming your EAD is from an I-140/I-485 filed by employer A. You will want to make sure that your I-140 is portable under AC21, otherwise company A could pull your I-140 causing your I-485 and EAD to be denied.

Try asking an Attorney and see if your wife can invalidate her h4 status by traveling and re-entering through AP at POE?

A quick trip to Canada can solve this problem?

This is not an advice, as I am not sure if this would work, but talk to a lawyer or as some suggested try another DMV.

But he can not loose our hopes, remember this, for the american people legal inmmigration is Green Card holders, if you are a temporary worker is like they are telling you hurry up pack your things and get back to your place, and the congress will try to work legal and illegal immigration at the same time, probably they will increase visas, but anyways the point is who is making noise in the streets? illegals and their supporters. In my case i contact my senator and my congressman every month asking to please help with comprehensive immigration reform, to help us to create legislation on name check so we do not have to wait years, and well all of them are republicans but all of them are immigrants so they know our pain.

I just applied for my little one yesterday.

fingers crossed!

Can't believe getting usa passport for my little one required two page application and just the birthcert, But for PIO they need everything in the world!

Yeah, because you applied for US passport for a US citizen :D, whereas PIO was permanent entry card for a foreign national. Naturally more documentation is required where foreign nationals are involved, look at your own green card process :D

EB-3-I is stuck in 01...not likely to move till Oct and then in OCT08..it will move by couple three months for the next 12 months till OCT 09..What are the option for EB-3 stuck here..from 01, 02, 03 ....

1) Convert to EB-2 ?.

2) wait for legislation from Logfren to pass

3) wait another 3 years...already in the Queue from 01..


If I choose to convert to EB-2..I have to put in a PERM and then I-140..what is the time line for getting my LC thro PERM and then my I-140 in EB2 cleared?? based on the current processing times..

Do I wait to see if Logfren's legislation goes thro ..if doesnt go with the conversion to EB-2...???

Please help me decide...

What you could possibly see at end-of-tunnel are:

Lofgren bill passing before election and recaptured numbers becoming available from 10/2008. All categories may become current and remain current for 6 months to a year.

OR

EB3 ROW becoming current atleast by end of next fiscal year (by 09/2009, so that EB3 I would start progressing at a faster rate.

OR

you (and everyone in EB3 I) would be asking the same question even after 3-4 years.

Oh well, Happy July 4th!!

i remember IV team was earlier posting messages asking members to send questions because they have enough room to accomdate those in the same week. so i think the number of question is less now. this might be one of the reason we have conference call with lawyer once in two weeks.

if they get more questions in future, they can have atleast one conference call per week or they can extend it 2-3hrs too. once we get more publicity and if our members count (and questions) are doubled or tripled, we can we have more sessions with same or different lawyer. what do you think?

I just noticed in I-765 that if you are applying for EAD renewal then they need you to send your current Employment authorization document! Did anyone that applied for EAD renewal send their EAD card with their application. I'm concerned because if one is working on EAD and needs to send this document 120 days prior for the renewal process and does not get the new EAD for couple months, what proof does one have on work authorization?

I dont want to apply online as I dont want to go for biometrics (FP) again for EAD!

Saurin,

Technically, your H-1B status terminates once you are no longer working for and being paid by your H-1 employer. Being on a LOA does not protect you from this unless the LOA is for reasons that are both personal and out of your control, such as serious illness.

A new employer can file an H-1 petition for you even if your current H-1 has not been cancelled. You will be required to submit recent pay stubs with that application.

You mention AC-21 and having an EAD, but your profile does not indicate that you have a pending I-485. Can you clarify?
