It should not be an issue. I know several people who have done this on a regular basis.

You can re-enter the country with an unexpired H1 visa stamp and by showing the new I-797. Change of employers does not invalidate a H1 visa stamp.

Filing the application to port as seperate after the 140 is approved assures the attorney & the employer of of 2 things:
1. The attorney gets more money for filing a seperate application.
2. The employer gets to keep you tied down longer since its likely that the USCIS wont know what to do when a seperate application is filed just to port the date. Its not a documented procedure (that I am aware of) in that you have to file Form I-xxx or whatever.

Best to port the PD at the time of filing the 140.

Disclaimer: I am EB3 and I havent tried porting my date to EB2. Just using my basic common sense.

I am still waiting for my PERM but i had talked to my attorney regarding porting of my old priority date he says i will have to wait till i get my new I-140 approved. I am not sure how should i convince him to file I-140 and priority porting application together once i get my PERM approval. I need some strong documentation to support my statement if he denies doing both together. I tried googling but yet to find some document related to this.

This is based on the assumption that 10% per county limit out of 290,000 visa. The law state No county can get more than 10% of immigration visa. Is that mean 10% of 290,000+480,000 or 10% of 290,000?

If the Law state that 10% of immigration visa ( which is 140,000 + 290,000). Then here is the amount of visa allotted to each county.

Clearly, legal, skilled immigrants from countires like India, China, Mexico and Phillipines are already facing 5-7 years backlogs and this bill, by reducing quotes from 140K to only 90K, is going to make this problem worse!!! To relieve this problem, they should've expanded quotas (atlteast temporarily), made soft countrycaps, and exempted dependents, but they are going in the totally opposite direction.

I read the bill posted for IV, and on page 259 it says for first 5 years after enactment, level of EB immigrants will be at 2005 levels (which was 246K)
90K will for for pending EB applicants, while ATLEAST 10K will for exceptional aliens in nonimmigrant status under section 101(a)(15)(Y). This means that these "exceptional aliens" will have a new quota of 246K-90K= 156K a year, while the qouta for existing EB immigrants will be reduced by 50K, thereby accentuating the horrific backlog that already
exists...

Question is, who are these "exceptional aliens" under section 101(a)(15)(Y)??

Thanks Everyone,

To the person who gave me red with the comment "post the valid reason." That was not necessary, you could have just sent me a message.

Anyhow, the reason is that the company I trusted & toiled for past 8 years is down the tubes, after having faced years of lies, deceit & false promises. I know it's all my fault for being so trusting, so now I am trying to forget that pain & treatment & just progress moving forward.

So from what I gather, I can apply for a H1-B now, but it will be only for 1 year? I want to do a "new" H1 instead of a "transfer", since the company finances are a BIG ZERO or -VE, so I have no paystubs to show. And then eventually I want to file new GC with this new company.

If you get one consolidated paycheck and W-2, you're fine. Otherwise, you will have a tough time explaining multiple paychecks and W-2s to the immigration officer when you go for visa stamping or when entering the country.

Hi,

Even my co-workers (including me) have not received their returned applications. I have a question here:

The Cover letter of my 485 petition was signed by MY EMPLOYER on the company's letterhead. Just in case, just in case, INS decides to return that application - will it be sent to my employer's address or to my residential address??

There was no attorney involved and it was not a concurrent filing with I-140.

It looks like I replied you sometime back.

Your best bet is to file another premium H1B showing all the background and your second I-140. Also attach a clear letter quoting the specific sections of immigration act. Time is critical here, and I am not sure how long the MTR for an H1 will take.

As far as i know PF is controlled by the central government, TCS will not have any say in you withdrawing your money. Generally there is an upto 15% match from the company in your account, and that is yours the moment it is deposited in your account. You should not have any problems withdrawing your money. Your money is yours. Some companies deposit PF monies quarterly, small companies deposit it annually, in those cases you might be screwed if you company did not deposit the money in your account.

Has anyone managed to withdraw money from TCS PF from Mumbai India?

If so, pls advise on the procedure for the same?

I had a very similar situation when i applied for a load a year ago. The loan officer was puzzled with my immigration status. He initially pre-approved the load and then he called and said that the bank can't approved due to my immigration status. However, the deny letter did not say that and said that the reason for denial was a completely different one. I spoke to a lawyer regarding this and he said that as long as I don't have immigration status / or origin of mine as the reason of denial in writing, I don't have a case. And, he said, immigration status can be taken into consideration when applying for a loan. As such, I re-aplied in a different bank and had no issues whatsoever.
