You first thought of calling me jerk privately, than changed your mind...Anyway, waiting in this country for 10 years without Green Card, I am certainly a jerk, atleast that's how I felt when I saw the Fijian guy who landed here in 2007 got his Green Card, you are right for that point. First point of your's that I didn't understand was 'I may annoy people'. I acknowledged that in my first post itself. If being ROW I was to get my Green Card in 1 year, I will certainly be unhappy if someone try to make it 2 years...secondly you need to tell me how this effort is going to hurt the entire effort, I am looking for 15-20 volunteers who can work with me on this. Since this is also on IV's agenda so, it is certainly not against IV's goals, But I will try to work only on 1 goal. I am not stopping IV to continue with it's efforts. The whole point is, as we have seen in all the debates, lawmakers see Visa recapturing as new visas. Go around and read some stuff, America is more anti immigrant today than it was ever, in this scenario, getting a bill passed with recapturing Visas etc. sounds impossible to me(I hope I am wrong), but taking of country quota or increasing country limits may be to 15% will bring lot of relief to the hugely baclogged countries...Moreover as I mentioned when a strong lawmaker like Zoe Logfren supports such thing, I'm sure she'll be ready to bring something for it....again don't tell me it is not possible. The problem with this guy is he has got his GC and now he doesn't want anybody to have it. Basically he enjoys when people are having of pain. That's the reason he doesn't want any progress in PD's. Hi, I think the best decision in current market is to go for GC with L1, following are positive points
Applying GC on L1 is faster than applying with H1.
You have your Job surity in India as well.
Current market u need to run for Jobs, on L1 I feel its cool as there is responsibility of you r company to take care of you.
If they start process now itself , you can get Labour cleared fast and I think u can change company after that. ( I dont know GC process but I got same advice, but I didnt listen).
Reason people go for H1 is to have job with US companies than MNC's who pay more, if u r not really thinking of changing company then its better to be on L1 and apply for GC. Also a lot of fredom to move companies.

This is a good beginning for a cause which gives us some relief in these retrogressed life.
We can atleast propose to USCIS, to accept 485 (if not approval), for those case, where I140 is approved, and the approval can be given in the normal PD schema.
This would lessen the burden on USCIS and facilitate the GC applicant to avail of AC21 PROVISION.
Also, we can highlight here that EAD renewal could be a great source of revenue for USCIS.
Please start this movement.

If I understand it right, the ability to concurrently file I40/I485 was introduced by the legacy INS through a memo in July of 2002 and it went effective almost immediately on July 31st 2002. I've tried to search for news archives on different law websites and to best of my knowledge it was purely an executive decision taken by INS governing body and no congressional or judicial intervention was needed to allow concurrent filing. In a very similar fashion, the new USCIS has indicated that it wants to discontinue concurrent filing in near future...an executive decision again.
Is it a possibility to get an audience with the USCIS director/start a letter campaign with the goal of getting them issue a memo allowing filing of I485/EAD even if the visa number is not available? The adjucation of the case would obviously happen only after visa number becomes available but as we all know this will be a big relief for all those who want to use AC21 provisions.
Passage of CIR/SKIL is very important in the longer run to reduce the overall greencard processing time and alleviate heavy backlogs but if we get this small relief right now it would help a lot of individuals from retrogressed countries waiting to file I485...and the good thing is, it looks like USCIS might have the ability to effect this change without a lengthy legislative process.

Nowhere in that statement he says anything about the name check. It might be just the expired biometrics. And coming from some anonymous immigration officials how can you be sure that the information is absolutely credible or represents the facts and not their speculations? Were those applications really approved or they've just requested the visa numbers for them?
